My motheris in care with dementia, her money has run out and the care home is threatening legal action, she has a home, but we do not have power to sell it, I know when mum wrote her will there was a clause that if she did loose her mental capabilities both my sister and me did have some powers to act on her behalf, so two questions really, thank you in anticipation of a reply

So that i can answer you fully, are you sure your Mother mentioned you and your sister had rights to act if she lost mental capacity in her Will? (It would normally be stipulated in a Power of Attorney document, and not a Willl, as a Will only comes into action upon someone's death).
