Can DRA companies still chase a fine even though we had permits,

This answer was rated:

Can 'DRA' companies still chase a fine even though we had permits, but they say we are too late to appeal, this was almost 2 years ago.

Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply. #

Alex Watts :

Just to clarify what do you mean by a DRA company please? Is it debt recovery agency?

Customer: Yes
Alex Watts :

Ok good.

Alex Watts :

Did you contest the ticket at all? When was it issued?

Alex Watts :

When was it issued please?

Customer: We spoke to the UKPC to complain and said we would not pay and they should speak to the property management company with regard to our permits, this was March 2012. Date if issue 31.3.2012
Alex Watts :

Ok and you sent them a copy of your permit?

Customer: Not at the time as we were miffed and said that property management should inform the parking company, but more recently as DRA have been to the new tenants flat to retrieve the fines we sent all information plus copy of permits.
Alex Watts :

Yes. Well the DRA company can chase, it but it wont do them any good.

Alex Watts :

You can show you do not owe it.

Alex Watts :

Even if they try and issue proceedings then you can show a Judge in a small claim that you had a permit.,

Alex Watts :

You should write back and say that the debt is disputed, you had a permit and that they have no cause of action against you.

Alex Watts :

Can I clarify anything for you about this today please?

Alex Watts :

If you get more correspondence then you can say you will charge £12 for each further letter and that you will complain to the OFT in relation to their credit licence to pursue debts]

Customer: No, I will go forward and write back to them and hope they will drop this, THANKYOU
Alex Watts :

Good luck with this.
