Hi i was due to apply for ILR in 2013 but i got a FPN(3pts

Hi i was due to apply for ILR in 2013 but i got a FPN(3pts and £60) in 2012 which i challenged but later pleded guilty and got same FPN(3pts and £60) from surrey magistrate court.
So my solicitor advised me not to go for ILR as its risky rather just extend my Tier 1, which i did.
When i applied for Disclosure Scotland to see my conviction, it came clean with no convistion. So my question is that is it safe to apply for ILR now knowing that Disclosure is clean or wait till the conviction is spent.

You may apply for ILR now as long as you do not have more than 1 FPN. You should declare the FPN on the application form.

It is fine, you may apply now as you have only got 1 FPN in the last 12 months
