Ask a Law Question, Get an Answer ASAP!
Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
Why do you feel you such keep some of them - because of the tone of the letter?
They arrived to me with my name and address on and the invoice stated as "PAID". I did not order them. I waited for 20 days and still had not heard anything from the company. I then get a rude letter stating that they sent them out by mistake. I really do feel they should have been more apologetic and perhaps have offered a goodwill gesture of, say, £20 worth of stamps at this point. The letter makes me feel very much as though I am to blame- had it been me in the wrong (and down a large quantity of stock) I certainly would have been writing a very nice letter to the customer. What is the legal standing please.
Its bad news I am afraid.
By law they do not belong to you, they belong to another
Therefore if you keep them it would be illegal
You could be sued by Royal Mail and potentially contacted by the Police
I agree the way Royal Mail have behaved is unacceptable.
But this is not enough for you to keep the stamps
I am sorry if this is not the answer you want and certainly not the one I want to give you, but I have a duty to be honest
Can I clarify anything for you about this today please?
Ok, please could you briefly explain how these aren't "unsolicited goods"?
Because they were clearly sent by mistake
This was an error by Royal Mail
They should bear any cost of return, but you still can't keep them sadly
OK thanks for your help Alex.
All the best
