If someone pleads not guilty to a charge in a magistrates court

This answer was rated:

If someone pleads not guilty to a charge in a magistrates court and is subsequently sent for a sentencing hearing does that mean that the magistrates found him guilty

Thank you for your question. My name is XXXXX XXXXX I will try to help with this.

He wouldn't be sent straight for a sentence.

If a person pleads not guilty then he is adjourned for a trial. Only if convicted is there a sentence.

The fact of a sentence would indicate that he either pleaded to something or was convicted though.

Can I clarify anything for you?

Can witnesses be called to a sentencing hearing prior to the hearing date

No, a witness would never attend the sentencing hearing by force.

And there cannot be a sentence before a trial.
