Got a quote from Virgo windows 20/04/2013 to put 23 windows

Customer Question

Got a quote from Virgo windows 20/04/2013 to put 23 windows and 4 doors on my house for 14,500. Paid 25% deposit to secure the deal. 6 month later the company is now saying that the quote is wrong the bill had now gone up an extra 5,000. I feel they are now in breech of the contract that is signed. Virgo Windows state that they do not have to honour me that deal. Can you advise me on my legal rights!

LondonlawyerJ :

Hello. I am a soliictor wiht over 15 years expereience.

LondonlawyerJ :

I iwll try to help you with hthis.

LondonlawyerJ :

You say you got a quote but also paid a deposit. Paying a deposit would normally happen after the quote stage and after a contract had been signed. Have you signed a contract and if so does this say anything about Virgo being able to vary the price and if so in what circumstances?

JACUSTOMER-1nmco2l9- : Yes I have signed a legal binding contract. There is no where on that contract that says they can change the original price.
JACUSTOMER-1nmco2l9- : If it is better for you my mobile number is XXXXX
JACUSTOMER-1nmco2l9- : Are you still on line?
LondonlawyerJ :

Yes I am still here. Like most of the solicitors on this site I fit answering questions here in amongst my legal practice. So sometimes there is a delay in replying.

LondonlawyerJ :

How are they justifying this increase in price? On the face of what you have said they have a binding contract they are attempting to renege on.

JACUSTOMER-1nmco2l9- : The manager states he acknowledge it is a fault on their behalf but he is not willing to do it at the orinal price.
JACUSTOMER-1nmco2l9- : I want to ring them back but don't know exactly what to say to him especially my legal rights.
LondonlawyerJ :

what does the agreement say about their ability to do this if anything?
