Right of access from a house to a C category highway. I have a rough stone vehicular access dating from 1979 which I wish to remake in tarmac and kerbs. Before the council will issue me with a'dropped kerb' application form, they tell me I need planning consent.
Is it not the case that as it has been in use continuously for 35 years, I have a legal right, and need not have to apply for planning permission?
