We trade from commercial property under a sub lease. The landlord is also the licensor of the brands under which we trade. We are behind on monthly license payments and have been served notice of termination of the license. There is a clause in the lease preventing us from trading from the premises under any other brand. If the license termination is confirmed what is our position vis a vis the lease liability?

In that case you should also treat the lease as having been terminated if you can no longer trade from the premises.

Termination of the licence would run concurrently with termination of the lease as the two are linked to each other.
