could you tell me what a defendants application for striking

This answer was rated:

could you tell me what a defendants application for striking out the claim and entering summary judgment without a hearing means?

This is an application to the court to strike out the claim against the defendant without a trial on the basis that the claim has no real prospect of success.

Can I help further?

Who would have made that decision?

I take it a judge would have made that decision do i get to see the defendants answer that made the judge reach that decision?

The defendant must have made such an application and if the court deems it to have merit, it will have ordered the striking out of the claim.
You may ask the court to give you a copy of the defendants application if it was not served on you.
