Hi, please help me. Ordered sofa from furniture village on

Customer Question

Hi, please help me. Ordered sofa from furniture village on 30th December told it would fit into the house with no need to measure, it didn't and also one of the sofas was broken. Store arranged for replacement said would take 6 weeks that was first week in March. Still waiting receive no contact from store unless we contact them customer service is beyond appalling. They have offered us £100 as compensation which we feel is a joke where do we stand can we cancel without paying cancellation cost or is asking for 10 per cent of the original cost unfair

Alex Watts : Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return You do not need to wait here as you will get an email when I reply.
Alex Watts : How did you pay for the sofa please?
Customer : Paid deposit of £436 with debit card balance to be paid over two years interest free credit
Alex Watts : You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this signed delivery and keep a copy.
Alex Watts : If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: or by completing form N1 and take it to your local County Court.
Alex Watts : The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.
Alex Watts : If the matter is defended it will be set down for a trial. If the claim is for £10,000 or less it will be a small claim and you will not need representation.
Alex Watts : Can I clarify anything for you about this today please?
Customer : So to clarify I can claim back the deposit if we decide to cancel.if we decide to go ahead are we in your opinion entitled to compensation having waited five and a half months and suffered a great deal of inconvenience, they have offered £100 but in light of the fact that we have taken time of work, had to drive to the store numerous times as they do not phone when they say they will had carpets fitted which is now not new, had furniture ordered which we have had to put on hold we asked for ten percent of cost of sofas are we being unreasonable
Alex Watts : Yes you can cancel and claim the deposit back.
Alex Watts : You may also be entitled to claim compensation of a nominal amount.
Alex Watts : Can I clarify anything else?
Customer : No that's all for now.will speak to furniture village again and contact you again if necessary, thanks for your help
Alex Watts :

Of course.
