Hello, WE ware married for 30 years and have (not legally)

Customer Question

WE ware married for 30 years and have (not legally) separated for the last 5 years. I now spend most of my time in Spain whilst my husband is in UK. He now doesn't want to pay me half of his pension.
What is your advice on the situation, please.

Hi thanks for your question, I will assist you with this.

It is important to realise that whilst many people presume as they have been married a long time they are entitled to half of everything including the pension, there is in fact no "automatic" entitlement to pension sharing.

Is this the only outstanding issue?

Have you agreed upon a division of other assets, such as the matrimonial home etc? Do you have a pension?
