my landlord has just told me he is going to charge me an extra

my landlord has just told me he is going to charge me an extra service charge every month for gardening, insurance costs for the parking area etc. Can he do this? I have been told that he can't. I am on an AST, it's not a leasehold flat. Can you give me any technical legal Act i can quote back to him, to say he can't do it?

Thank you for your question. My name is Jo and I will try to help with this.

Its not a question of a statute. Its a question of contract.

You have an AST. That is a contract. He cannot vary the terms of a contract without your express agreement. That is a principle of law.

What he can do is give you notice that he intends to increase the rent at the end of the AST. You do always have the option to ask the Rent Assessment Committee to assess the rent for fairness though.

Nevertheless, whatever you quote to him and however brilliantly you argue, he is not likely to agree with you. Whether you convince him or not matters not. The issue is whether or not you have a challenge in court should it reach that point and indeed you do.
