I have a tenancy agreemnt for my allotment, this was made out

This answer was rated:

I have a tenancy agreemnt for my allotment, this was made out in 2011. Signed by the then secretary of the Parish Council and myself, last week I had a letter from the Parish Council saying that the agreement was made out in error, however I have worked very hard on my allotment and now it is producing vegetables, it is neat tidy and well cared for and I havent contrevend any rules. I am not about to give it up as it was their mistake so they have to live with it.
What would your advice be in my position.

LondonlawyerJ :

Hello, I am a solicitor with over 15 years experience. I will try to help you with this.

LondonlawyerJ :

You have been working the allotment since 2011 & now they say it was a mistake! I think you reaction is absolutely right. In general contract law the time for them to claim a mistake is long past. By not allowing you to work the allotment for this time they have accepted your right to do so. This is the position on general contract law but your allotment may have specific rules that alter these general principles, eg there may be a right to take back the allotment for any reason on a set period of notice.
