I have a major claim in process (£14,000) with 51% chance of success. however, the major car company that is being sued is not responding to my solicitors outline claim. The choice given within the claim was: 1. supply a courtesy car. 2. Reimburse hire cost. allow use of returned car without predjudice.
Can I sue in small claims for out of pocket hire charges, for which I have receipts?

Can you tell me a bit about the claim?
Have they not repaired your car under warranty?
If this is a contractual claim then you need to prove that your loss is a reasonable forseeable consequence of their contractual breach. Having to hire a car because they wont fix your car for example could be construed as a naturally occurring and reasonable forseeable consequence.
