after nine years of service working at a working mens club, I was barred for five years but told i could still work. Is this allowed.
Alex Hughes : My name is***** and I'm happy to help with your question today. I need to ask you some preliminary questions to be able to help you.
Alex Hughes : We're you employed there? Why were you barred?

yes with a contract. I had a disagreement with a customer outside my shift.

Alex Hughes : And how long ago did this happen?

around 5month ago

Alex Hughes : OK, understood. The only thing I don't have are the rules of membership and expulsion. Are you able to get them? I need to see what the rules are about barring members.

that is the problem, you are not allowed to become a member if you work behind the bar.So how can they barr me when im not a member,Im a member of staff.

Alex Hughes : I agree; that makes no sense at all. But the rules of the club govern how people join and are barred. Without looking at the rules I cannot say precisely whether their action is right or wrong. The law will not help you because this is probably a private members club which issues it's own rules and regulations.

But the rules should be abided for everyone not just individuals.

Alex Hughes : The rules of the club will only apply to the members and other users.
Alex Hughes : Unfortunately I can't comment on the rights and wrongs of their action without seeing their rules.

im not sure how to get the rules, as it seems them make them up as they go along for each individuale

,there are no rules displayed

Hello my name is ***** ***** I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return You do not need to wait here as you will get an email when I reply.
It's bad news I am afraid. Members clubs can make their own rules and run it how they want to. As long as they do not discriminate on the grounds of race, sex, age, colour or religion etc they can do what they want.
So if they want to bar someone for life, as a private members club they can. It's their choice. But as long as it is not on the discriminatory ground above.
I am sorry if this is not the answer you want and certainly not the one I want to give you, but I have a duty to be honest.
Can I clarify anything for you about this today please?

I understand they can make their own rules, but when someone does the same as you but on a bigger scale and get nothing but a slap on the hand.I got sacked from a nine year possition then got re enstated but told I was barred for five years but could go in only to work.Nothing makes sense.

I agree but sadly if you were sacked you could take them to a Tribunal. But any members club can stop you going in.
Its unfair but the law doe snot prevent it - I am sorry.

Thanks for your response but I still feel like I have been victimised against. Thank you anyway. I believe there are rules made by the cniu that even the club has to abide by.

I agree with you entirely.
