Ask a Law Question, Get an Answer ASAP!
Hello my name is ***** ***** I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
I have reviewed your previous correspondence.
Yes sadly you bring the claim you must prove it
You need to show that you believed the contract was between you and her
You need to show that you paid her personally and not the company, so any receipts etc that you have
Further if there are any adverts that she uses, which shows her name and not a Limited company that helps
Can I clarify anything for you about this today please?
Thanks for your reply. I pay her in cash and have never had a receipt. I just arranged the date of her next visit at time of payment. To the best of my knowledge her van (she is a mobile service) makes no mention of a limited co. and I was never given a business card as we already had her phone no.
If there is no mention then that suggests she is not.
You need to take photos of the van etc.
But you bring the claim you have to prove it was a personal contract
Say you never had an invoice, receipt etc, so there is no evidence you paid a Ltd co
Does that help?
She definitely is a Ltd Co. I will check her on-line advert.
