Dear Sirs I am a joint executor if my late mothers estate,

This answer was rated:

Dear Sirs
I am a joint executor if my late mothers estate, my brother was the other executor.
We had a disagreement over the probate and put it in the hands of my Mothers Solicitor.
Her flat was on the market before she passed away.
Of course it is taking time to sell so my Brother has been pushing the estate agent and Solicitor to lower the price from £70,000 to £ 60,000.
I will not agree as the flat is worth the asking price, it has new fully fitted kitchen and fitted bedroom
Can they force this issue, I am adamant I want it to stay on the market.
Can you please tell me if I can stick to my decision or can they force me.
Thank you
Jenny Elston

Thanks for your question. My name is***** can assist with this.

tdlawyer :

No, they cannot force it as such, as you have to have the agreement of the joint executors to do this.

tdlawyer :

However, one executor could make an application to the Court to decide what to do, although for the sums involved here, I expect it would be the last resort as the costs of the application etc. would probably get close to the £10k or so figure that you're taking about.
