Before my mums death earlier this year, she had , over a period of time been giving me cheques to put into my bank account in the UK so that I could then transfer the funds into my premium bond account. The premium bonds were hers, not mine but were kept in my premium bond account. Now she is no longer with us, are the bonds legally mine or are they classed as part of her estate and can family members lay a claim to them?
As the bonds are in your name, you are the legal owner but your mother was the beneficial owner of the bonds and as such you would be holding them for her as a trustee.
So the bonds would be part of her estate.
