I was on a Tier2 Migrant care workers until 20th may 2013, I applied for discritionary leave which has been refused but have right of appeal. I understand I am under section 3C - continuous stay on the basis on my previous ground. I have been advised to apply for settlement as I have completed 10 years in the UK, If an appeal is withdrawn and a fresh application is made for settlement, will I lose my right of work as section C will end ?

You are allowed to vary your application whilst under S. 3C leave to remain, so your S. 3C leave will continue as will your right to work until your varied application for settlement is decided.
