I am writing to you concerning the flooding of my vehicle whilst parked in an official car park at Eindhoven airport, Netherlands. The vehicle was parked legally in a marked space next to a boundary fence , beyond the fence is/was a stream/small river. The vehicle was parked on 26 July 2014 and I returned to take the vehicle on 29 July 2014 when I discovered it had flood water inside it. I informed my car insurance company and they took care of the repatriation of the vehicle to the UK. Upon inspection they have written the car off as a total loss and paid me.
In the meantime I contact the airport authorities and told them of my calamity and requested compensation from them. They responded with an offer of €20- which was the price of the parking ticket and informed me that my vehicle was not the only vehicle to be damaged over that weekend due to the weather. This offer was refused by me and I have requested they provide me with a risk assessment for the use of the car park and a reasonable offer of compensation through their liability insurance. They have refused.

You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this international signed delivery and keep a copy.

If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: www.moneyclaim.gov.uk or by completing form N1 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to your local County Court.

The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.

If the matter is defended it will be set down for a trial. If the claim is for £10,000 or less it will be a small claim and you will not need representation.
