Customer Question

We were under the impression when we purchased the farm the land in question was in the title deeds. We have acted as owner occupier of this area of ground for the last 33 years and only recently when our neighbour put their property on the market it has come to light that the area of land we have been farming is on their title deeds. If we have always farmed this area must they offer us a tenancy on the bit of land?

Thank you for your question.
No, not where it's a simple mistake as to ownership. There's no intention to create a tenancy under those circumstances.
