Customer Question

A property is unregistered and was previously owned by A and B. A dies leaving the property to B. A's will created a discretionary trust so B is not the only person with an interest in the property. Will Land Registry accept an application for Voluntary Registration and just create a Trustee Restriction or will the new trustee need to be registered on first registration as co-owner?

Hello and thanks for using Just Answer.

My name is ***** ***** am happy to assist you with your enquiry.

I trust A and B were holding the property as Tenants in common?

I don't fully understand when you say A left the property to B but also created a discretionary trust? Could you please give me some more information on this please.
