I have had a letter from HMRC regarding my use of an EBT scheme

Customer Question

I have had a letter from HMRC regarding my use of an EBT scheme several years ago. The company running the scheme has been wound up and are not providing any support.
Since I used the scheme I have suffered a personal bankruptcy. As any tax HMRC claim was due prior to my bankruptcy, do they have a case?

Hello, I am Keith and pleased to be able to assist you in your enquiry.
I would submit that as HMRC's debt, if any, preceeds your personal bankruptcy then any such debt is extinguished thereby. I would suggest that HMRC be so advised.
I do hope I have shown you a way forward in this matter.
