DWP debt

Customer Question

My dad died suddenly 2 weeks ago he had been paying back a debt to the dwp monthly, was in his name only and had nothing to do with my mum. Will she be made liable for this debt? She is phoning dwp tomorrow.

She's thinking because she is basically next of kin they might chase her for it

Did he leave any money?
Do they jointly own property?

He didn't have a will and they live in a council flat. Only money he had was his months wage every month

She isn't liable for his debts.
The only issue she may have faced would be if the DWP claimed against his estate or if they brought a claim against any jointly owned property.
Unless they are going to allege fraud on his part and compliance with that fraud on hers, there is no claim against her.
