I was disqualified from driving 10/04/2012

I was disqualified from driving 10/04/2012 for failing to provide a breathe specimen, I received a 3 yr ban
I contacted the DVLA in January to confirm what I needed to do to apply for my licence back on the 10/04/2015, I also asked what my driving ban code was so as to be able to forward to insurance companies in preparation for quotes, I was told it was a DR30.
A D1 form was sent out which I completed and returned..on the 10th 04/2015 I called DVLA again asking where my licence was... I was told the application had been refused as the form was incorrect and that I needed a medical before I can drive / have it returned as I'm a High Risk Offender.. aftrer 3 yrs and the january phone call this was the first time I was made aware of it.
I have since looked at section 88 of the road traffic act 1988 and quote "Any high risk offender convicted and disqualified before 1st June 2013, who is not currently disqualified, whose licence has not been revoked for medical reasons and a qualifying driving licence application has been received by the DVLA may still retain legal entitlement to drive under Section 88 of the Road Traffic Act 1988 while awaiting the DVLA to determine their fitness to drive."
Which certainly seems to appear to me that as I have paid for my licence, they have received the application, I'm no longer disqualified, and it was'nt revoked for medical reasons they should return it to me??
If I don't get a copy of it by the end of this mth I stand to lose my insurance and 10 yrs no claims bonus! My Insurers just need a copy of My licence, yet the DVLA will not send it out to Me!
I have explained this to the DVLA and they say they can hold it..even though I can drive until the medical.....

From what I gather the DVLA should have to return my licence as per section 88 of the road traffic act??
