Responsibilities of Trustees and Solicitors
I made some investments in forestry "schemes" some within my SIPP,others outside it but funds paid to trustees of the scheme or to solicitors who then passed these on to trustees.
i have written to all concerned holding them liable for lost funds along with the annual returns added in at the statedannual level - 12- 18% compound. Do i have a cause of action? I have held the 2/3 parties involved jointly and severally liable. I have held one man liable pesonally as well as his company which owns two of the trustees concerned. My searches through companies house point to massive fraud with trustees and solicitors inter-linked and in the case of the solicitors who were paid for onward transmission to scheme trustees, they acted evasively when i enquired. This evasion is logged with dates of phone calls unreplied and then aletter of complaint to them which elicited the response
"sorry but I have had to call for the file to be broughtfrom storage so it will take a few days"
Pure stalling, surely, as it's all on computer and you don't archive files for 6 years - this file was about 2 years old.
Finaly, I'm sure that I read somewhere that my SIPP trustees can also be held liable - that's why very few pension fund trustes will accept eco-type investments into the fund?

May I clarify with you the fraud you believe to have occured please? Do you suggest embezzlement of your funds or is it just the potential commission arrangement you beleive exists between the SIPP provider and solicitors?Were the solicitors in question acting for you or the SIPP trustees?
