My husband and I have a company doing PPI claims for me for 2 years now in the past few years they have sent us numerous letters to sign which we have done up till a few months ago when our friend was suffering from Cancer and died in Feb this year I didn't sign the letters Banksmart sent me now they have invoiced me for minor defaults on my claims I got in touch with them and told them of our bereavement and the put the charges on hold fot 30 days and we have signed letters again also to cancel any claims there is charges of £100 for each one do we need to pay the charges we need advice Mr and Mrs XXXXX

Thank you for sending this. In terms of clause 12 of the contract binds you to cooperate with the claims process and if you don't return the documents required for your claim they can seek recovery of also able costs.
What are they charging you for specifically?

Breach of contract, we have signed documents now and Banksmart say they have put invoices on hold for 30 days, but now that we are signing documents can they still charge us

Sorry the tail end of my last narrative should have said "reasonable costs". That is what they can charge of you don't cooperate with them in pursuing the claim. That is because they work on a no win no fee basis.
Reasonable would be such amount as to compensate them for additional work. If the claims are now back on track then that would be cost of extra correspondence to you and any other out of pocket expenses they have incurred as a result of your delay in instructing them.

Thanks for info we will keep going with the claims but we don't think we will receive any money as we don't think we had PPI on any loans or bankaccounts
