Several years ago I tripped over a trestle which had been left on the footpath by contractors who had been employed by 'Traffic for London'. According to the manager of the shop close it had been left for some weeks even though he had reported it on several occasions.
I had three witnesses, one which helped me to my feet and took photo's. However after several years of being pushed from one department to another by TFL my representative proved beyond doubt that it was the fault of TFL. As you would expect they continued to deny this making up all sorts of false stories.
Finally when it came to my day in court, the judge did not even bother to hear my witness and in fact dismissed him immediately. She through the case out with no grounds for appeal and I have now, twelve months later been handed a bill for over £22,000 for the costs of TFL.
The injury caused me severe problems and contributed to my bankruptcy and the sum I was asking was for a very small amount by comparison to what I have now been handed for their costs.
The McKenzie friend who represented me had previously been a QC for 20 years in London and said that he could not believe the manner and attitude of the Judge.
I am now almost 75 years of age, and prior to this I was a very strong man. Today I am a pensioner receiving pension credit to help me.
Obviously there is a lot more to this but the system has failed me and I believe that something untoward took place in that court on that day, so does my representative and so does my witness who was completely dismissed without having said a word.
I would appreciate your help. I cannot pay this bill. I was told I could not appeal and I am at my wits end with worry. I was the victim here and all these years later I am still suffering in every way. Can you advise?
