a competitor has purchased a domain with our trademarked name on "balsajo".
he has set up and is using it direct people to his website.
is this illegal? we sell the same product.

Hi thank you for your question and welcome. This company is potentially breaching your Registered Trade Mark. Is balsajo registered as a logo?Your options are to either:(i) Get a solicitor to send them a letter asking them to cease or desist -this has to come from a solicitor to show you know your rights and have taken advice, it will give your complaint more gravitas. If they do not stop, you could consider suing them for an injunction and damages - See Trade Mark Act 1994If you contact the Law Society they will recommend a solicitor. (ii) Alternatively you could make a complaint to ICAAN - they are able to settle disputes over domain names look forward to hearing from you.Kind regards AJ
