Our son has peen accepted in his preferred state school after paying the deposit in a private school,are we still liable for the fees in the private school?

By paying the deposit and entering into a contract with the private school you are subject to their contractual terms and conditions so a term's notice is generally required irrespective of the school he was at at the time. The simple and only issue is that you enters into a contract.
The school may elect to waive the contract but they don't have to.
