Customer Question

When someone is interviewed under caution by the police:
1) can the attending solicitor request a copy of a recording of the interview?
2) can the suspect being interviewed request the presence of a third party, for example, a friend

Hello,I am a solicitor with 20 years experience, I will try to answer this for you
1. The solicitor is entitled to a copy of the recording if you are charged. PACE code 4.19
2. YOU can request but the police are under no obligation to allow this.
I hope this answers your question , but please feel free to ask further questions.

I posted my question under the tab Scotland and it so it refers to Scottish law. I note you post under Londonlawyer, so I wonder if your reply reflects the legal position in England and Wales rather than Scotland.

It does. PACE doesn't apply in |Scotland. I will opt out.
