My Solicitor started my case before the legal aid was awarded

This answer was rated:

My Solicitor started my case before the legal aid was awarded due to the court dates. i've now been awarded legal aid for the full cost, but now my case is finished, my solicitor has told me that any work she did before the legal aid was awarded I have to pay for myself as she can't back date the work, even though legal aid has be awarded for the full cost. is this correct?
Hello my name is ***** ***** I will help you.
Did you sign any terms and conditions?
Customer: replied 2 years ago.

No I didn't sign anything. The Solicitor started the work and then asked me to produce payslips.

Customer: replied 2 years ago.

i did have to pay the Solicitor a bond which she said was to cover the costs in case i get rejected on legal aid. she has now finished my case and said that i won't get the bond back as she can't back date the initial work she did before legal aid was granted.

So you never signed anything at all?
Customer: replied 2 years ago.

i didn't sign anything at all. everything was done verbally with the solicitor.

And never said you could be liable for costs?
Customer: replied 2 years ago.

i was told i had to pay the bond in case i didn't get accepted for legal aid. she told me that if i got accepted i would get my bond back. now she has finalised my case she is telling me that the work she did prior to legal aid acceptance is my responsibilty and she can only claim for the work done after the legal aid was awarded to m y case.

Ok. Then you are not liable. If you have not signed any terms and conditions then you are not bound. Further the solicitor has carried out the work and been paid by legal aid. They can not change you also for the work too. So no, you do not need to pay.
Can I clarify anything for you about this today please?
Customer: replied 2 years ago.

the solicitor is claiming that only part was covered by legal aid as she started the case work before legal aid was granted. she is claiming that she cannot back date any work on the case, and as such legal aid won't cover that part of my case.

You need to ask for Evidence of that. Even so if you didn't sign any terms and conditions you are not bound and they can't charge you.
