I was buying a house and it was being handled on behalf of the vendor by an executor, we agreed a price but the executor wanted the purchase completed on auction terms with a ten percent deposit and to complete within 28days !!.l did not have a problem with these terms as in September I purchased another property from the same vendor at auction and the deposit went from the auction house direct to the vendors solicitor without any contact whatsoever with the executor!. The house I was now buying was being sold to me by the vendor outside the auction because he was not happy with the way the auction handled the sale of the last house I bought ( he was also selling 3 other houses at the same auction). The vendor was happy to sell me the new house to me before it went to auction because it was £2000 above the guide price given by the auction house and he would have no costs and would get guaranteed money and get his money a lot quicker as the auction was still 5 weeks away!!!. The problem now started because the executor stated that he wanted the deposit £14200 put into his own account instead of direct into the vendors solicitors ( which was the same as the previous house I bought from the vendor !). My solicitor was not happy with money going into the executors account as it was an unusual request ( as did the executor agree with in an email at a later date!). I deposited £14200 into my solicitors account and he got the ball rolling with the vendors solicitor asking for draught contracts on the new house and informing them that they were also holding my deposit !!. The vendors solicitor would not respond at all and when pushed at a later date informed us that they could not engage with us as they were instructed by the executor to only deal with the auction house ( the executor denies this !!!) . I informed the vendor and he told the executor to sell to me on behalf of his family but he would not listen!! . I am not happy with the outcome because I feel I was obstructed by either the vendors solicitor or the executor from buying the house because the house went to auction and I lost it !!!. Something is not right here between the executor, the auction house, and the vendors solicitor!!! . I have incurred costs during this process
