Customer Question

We have a business selling mattresses, mainly customer returns, discontinued lines, clearance, damaged packaging etc, usually branded from high street retailers. As they are sold through their wholesale disposal route, some we buy direct, some we buy through third party auction houses, they do not carry any manufacturer warranty.
Can we sell these mattresses without warranty if included in a disclaimer?
We sell most of our products through eBay or online but customers are welcome to come and view/inspect items prior to purchase.

You don't actually have to provide a warranty at all. Do bear in mind though that they still have sale of goods act rights against you that amount to a warranty in any event. Including a disclaimer does not change that.
You can include a disclaimer of course and that does deter a lot of people from taking action but it has no other merit in law.
