I now need this to be answered by a Solicitor with a Civil background.I am acting as a Litigant in person and have had my hearing thrown out by a Circuit Judge This was a multi-track case The defendants were asking me to supply documentation, I told them that they already had it, because they wrote the documents that I was going to be using against them. I was given an Unless Order to produce the documents I maintained that they already had the documentation, which they knew full well that they did. Back to top Meaning of disclosure 31.2 A party discloses a document by stating that the document exists or has existed ====================================================== I have maintained throughout that these documents existed; the defense knew the only way that they would squirm out of this was on procedure, which is what they have done. The defendants have already been successfully prosecuted in the Crown Court. I now would like to get the Circuit Judge’s decision overturned because she ignored Civil Procedure Rules, not just Part 31 but also PART 3 - THE COURT’S CASE MANAGEMENT POWERS, order new trial etc., etc. I now need this to be answered by a Solicitor with a Civil background. I am content to wait for an answer, but the answer needs to be applicable to UK Civil Procedure Rules, and not those of the US Legal system.
One last thing can you make sure that the answer comes from someone with Civil knowledge and not other areas of the Law.
