Re. 60ft Silver Birch Tree in neighbour's garden. Said tree was dug up as a sapling on common land after '87 Storm and planted by neighbour. We moved here in 2003 when the tree was regularly cut back by neighbour's mother (since deceased). It is now cutting out sun from our garden in summer to the extent that plants and shrubs, orginally planted in full sun, do not flower properly and our washing line is now often in shade. Add to this the millions of seeds it sheds in autumn and ditto the leaves, and it is a nuisance. I spoke to him about the possibility of cutting it back (not taking it down) as it hasn't been done for 3/4 years and he was aggressive and petulant. Had he been more amenable, I was going to offer to pay a share of the cost, but not now. Although it looks as if he won't do it, judging by his response.
Do I have any rights on this please?
