A baliffe came to my house and said he would clamp my car.

This answer was rated:

A baliffe came to my house and said he would clamp my car. I said I would call the police. The debt owed was by my son who does not own a car. This was explained to the baliffe but he said he would clamp the car. I told him that would be illegal. He the asked to se the insurance policy or car log. I fetched the insurance policy but he the demanded to see the log. I told him to leave. He did. What is my situation with regard to the baliffe or his firm?
1. Dear *****, a bailiff is not a licensed highwayman. Here, you were quite correct in telling the bailiff to leave your premises as he has no authority to go around clamping cars willy-nilly. The bailiff only has authority to attach or seek out the assets of the debtor who owes the money. Here, your son. A bailiff has no authority to attach assets belonging to innocent people, such as you. Accordingly, you did the correct thing in formally writing to the Local Authority for whom he works. The behaviour of the bailiff here is criminal. So, if he returns, then you should get a solicitor to write a legal letter informing the bailiff that he has violated the law if he touches any of your property. If he clamps your car, then take an axle grinder and cut the clamp off your car.
