Hello, we had a boiler installed by British Gas and due to increased hot water pressure we had a water leak causing damage to our contents and property which is currently being handled by our insurance company. I made an official complaint in writing about the incident and subsequent poor customer service received. They have offered £750 as a ‘gesture of goodwill in reflection of the issues you have experienced’ but they do not accept liability for the water leak under their terms and conditions clause 12, they state this was down to our existing pipe work. This amount is their full and final offer and they wish me to sign and return a ‘Form of Discharge’ worded as follows:
‘ We agree to accept from British Gas Services Ltd the sum of £750 in respect of damage to my property. This is a gesture of good will and British Gas does not take liability for the damage as the leak occurred from existing pipe work.
This sum is in full and final settlement of all claims, present or future, which we have or might otherwise have against British Gas Services Ltd in respect of any matter arising out of the above incident.’
Signing our legal rights away was never discussed so this document has come as a shock. They claimed to be sorry for what had happened and felt they should make a financial offer in recompense for the catalogue of appalling service we received even though they state they are not obliged to do so.
I am now unsure what to do, I would have accepted the £750 but with these added strings I feel it will prevent our insurance company from making a counter claim.
