Hi i hope you can advise me, iv been in the building game for 30 years making furniture as well as conversions jobs and have made a good reputation for myself, on word of mouth only with no complaints of my standard of works, i started a job on a mobile home a small timber frame extension to front and back and side and to replace roof tiles and inside works, she told me that drawings was done by her ex husband as weather was so bad i couldnt complete some works on the outside, so i told this to the client and she was happy for me to start works on the inside as planed, as weeks went on working on inside (and the weather still bad) everything was going ok until one day i went on the job and she started to complane about things that wasnt right to the underside so i said i carnt concrete trench and untill the weather was better cos the concrete will wash away, (the trench was for more floor supports) she knew all about this before i started on the inside she told me that she had another builder to look at my work and said theres not enough supports in, so i said thats all inhand until the weathers better, so she told me she didnt want me here anymore, i was shocked to here this so i turned round and said ok i will concrete the the trench now and put the supports, she said just go so i walked off the job, the total job was £28k she paid me £14k up front iv been on the job 6 weeks and materials at £8k+ my labour has come to about £6k already now she demanding for all my 6 weeks labour money back now, i tried talking with the client that to complete the floor support labour and materials will only come to about £250 she said no i want all your labour costs. is this something you can advise me on as this is my first complant after my time as a carpenter, builder, joiner many thanks sam

yes she demanding all labour money back, no she didnt but i offered and she declined my offer
Ok, in that case you do not need to offer anything back. She has failed to mitigate her loss. That is she has employed another builder when it was not necessary. In any event you have not said there was anything wrong with your work and she stopped your work mid-production. As such she can now not claim the money back, because even if there was a problem she didnt give you a chance to put it right.Therefore she has no claim and failed to mitigate her loss.Can I clarify anything for you about this today please?Alex
