I bought a used car from my local Audi dealership one year

Customer Question

Hi. I bought a used car from my local Audi dealership one year ago. As part of the contract and sale road tax 12 mnths was included. As at this point the actual tax disc was ablioshed I assumed my vehicle was taxed. I have driven the vehicle all year and get it MOT 'd in march at my dealership. It transpires the dealership discovered a mistake had occurred and in fact no tax was applied for . Without telling me , the start to try to cover their track by processing application and VO5 for tax. It was not until I returned to uk from hols the car park airport guy told me he could not deliver my car to me as it was not taxed. I was amazed to find this out. I complained to the audi dealearship and they have investigated . My issues are breach of contract at point of sale - ie no tax, allowing vehicle to leave their garage with no tax, the fact that my insurance may be null and void if I was invield in accident due to no tax.. that 3 weeks ago they discovered the error when I put car in for mot and they made steps to tax car but stil said nothing to me allowing me to use vehicle on road thinking I was insured, whenb they new I was not. The sales manager of the dealership admitted to me today afdter his investigation ther ehad been a process error at their end at start , and yes they had become aware of te hno tax issues nad he had no idea why I was not told.
I feel strongly that a breach of contract and professional negligence as occurred allowing me to drive the car when they new I was not taxed and trying to hide it this .. Can I take them to court for what they have done ie no tax at sale and try get some compensation for the risks they have exposed me to and the professional neglect not letting me know

they have accepted they was human error when the car was sold to me on year ago was their mistake ..and that it appears they did know I was not taxed when they Motd the car 3 weeks ago but failed to tell me about it They said this was wrong also... and they accepted I have been at risk of being in court for no tax or worse if I had accident my insurance may not of paid up etc

Ok. I'm not sure what you are hoping to claim for then? There is no loss?

what about the danger of me running with no tax etc... no insurance and the fact they new this and failed to tell me

Yes, I understand the danger but the point is that came to nothing thankfully. You cannot claim compensation for being exposed to risk in the UK. Unless you were actually stopped and fined there is no loss.If they have paid for tax now that is all the law will require them to do.

I'm very sorry but that is the reality and there is no way of sugar coating it. There is just plain no loss. Can I clarify anything for you?Jo
