Hi, i would like to find out about a business name i may be using for the business i am starting up soon, i have called my business 'Mr Buff Valeting' i have registered the domain name and have linked it to a website, startet a facebook page, a twitter page and a google plus page but having done a search there is another business called mr buff valeting on facebook but they are based in plymouth, there is also a mr buff who does valeting based in bournemouth, i am based in king's lynn in norfolk and i am a sole trader and only cover a 40 mile radius of my area, the one in bournemouth has registered the domain name but not the valeting in the title, they have not got a website and niether has the one in plymouth, i am using the tagline 'car looking rough? then call mr buff' none of the others are using this. having done a check on companies house, nieiher mr buff or mr buff valeting are registered.I would like to know if its ok for me to use the name or could i be sued, many thanks, ***** *****

Then because this is so generic I think you will be ok. The test is can customers be confused.Bearing in mind they are over 200 miles away each and your catchment area is going to be local.It can only be a problem if customers get confused, with this because its so generic I dont think they will.You cant use a logo or wording that is similar. Apart from that you will be fine.Can I clarify anything for you about this today please?Alex

i would have thought that if any of them were that bothered then plymouth and bournemouth are only 126 miles apart and that may cause confusion with the locality of them two businesses
