Customer Question

I took advantage of a free trial of a download site named . I accessed it once and decided it was not suitable, but I forgot to cancel before the trial ended and it ran over for another three weeks. I am now receiving letters of claim for a whole years subscription . I have offered to pay for the 1 month I could have used the service, but they are now asking for 134.77 EUR. The letters are coming from a German Collection agency. I have told them to sue me. They are saying it is contractual . are based in San Marina and there have been many complaints about them. Am I within my rights to fight this. D Cropper

are you prepared to risk being sued?

From a contractual point of view, you would seem to be locked in. Come what may, you didn't cancel in time and there is a rolling over period. However, the chances they will sue you cross jurisdiction for such a low sum are almost zero. It is just not cost effective to do so. They could. Nobody can offer any guarantees but it is not likely. If you were to refuse to pay you would probably escape without action. Can I clarify anything for you? Jo

Thanks Jo,
It is as I thought, very unlikely to sue for that small amount, their legal costs would outway the gain.David
