My wife got caught using my travel card on Thameslink and is being prosecuted. Is this a criminal offence? If so, is there anything we should do to avoid getting a criminal record? Such a penalty seems disproportionate!
Is she being dealt with by TFL or the police?

We've received a letter from Thameslink saying they were taking the case to the Magistrates Court.
Customer: replied 1 year ago.
It was a Thameslink employee who caught her on the train.
Ok. That is a criminal offence but it is not recordable so won't be added to her PNC and therefore will not show on DBS checks.Breaches of the Railway Bye Laws are criminal but not recordable.Can I clarify anything for you?Jo
