In accommodation run for Young Persons aged 16-25 can we spot search rooms if drugs/illegal highs or weapon are suspected to be present. The contract with the commissioning service does prohibit these items being present

The contract is between the commissioning agency,usually Torbay County Council and our company. The young people themselves do not sign terms and conditions. We are looking to put a policy in place that will be available to the commissioning body that stipulates our terms in conditions in working practice.

Ok - if you have a policy then you are ok. They are staying at your accommodation and as such you can impose rules and regulations. If one of those is random searches, then as long as you are not discriminating on the grounds of race, sex, age, colour, religion etc then this is something you can do.They have to abide by your rules, so searches are fine.Can I clarify anything for you about this today please?Alex

We have also stated in our draft policy that we can seize" prohibited items such as alcohol,drugs or weapons". Can we legally do this or would we require the police to do so?
