I have taken out a new car insurance policy, and unintentionally missed the part on the policy that asked if the car had any modifications. we were hit by another driver who admitted liability, but when our insurance company were taking details of the claim they asked if the car had any modifications, i told them that we had side steps and tinted windows fitted when we brought the car. Now they are refusing to deal with the claim because we never told them about the modifications.
Can they do this, or what are our options.

Thank you for your question. if this is a no fault claim then just ignore your insurance company and go to your solicitor who can intimate a claim to the third party insurance company for you in respect of the claim you have. There is no need to go through your insurance company and your solicitor's costs should be paid by the other insurance company over and above the amount of your claim.
