Customer Question

I had a motorcycle stolen from a Hotel Car Park it's advertised as a secure car park on their Web site.
After the incident the Hotel Manager pointed out that none of the CCTV worked and the Barrier Gate entrance was faulty.
Do I have a case against them for failing in their duty of care ?

What, if any, disclaimers are there at the car park site or on the hotel website?

Only the generic your vehicle is parked at the owners "Risk" well at the time I failed to see the risk if you see cctv cameras and are told it's secure the risk isn't very high.

I think you have stateable grounds for an action for damages on the basis of the failure of the owner to take reasonable care.
