I have typed Quotation in my Estimate by mistake & now my customer is claiming I provided them with a Fixed Price Quote despite the Heading on my headed paper reading Estimate.
Where do I stand?

Hello my name is ***** ***** I will help you with this.

Does it say anywhere errors and omissions excepted?

Customer: replied 1 year ago.
it says it at the bottom of the letter

Ok - then that is ok.
It clearly says estimate at the top and says errors and omissions etc.

Therefore you are NOT bound. This is clearly a mistake.

They can not insist that you are bound.

Can I clarify anything for you about this today please?

Customer: replied 1 year ago.
Thank you Alex for clarifying this. The customer is threatening to take us to Court based on the following -
This quotation is subject to a fixed price for 60 days and thereafter subject to current market fluctuation.
It should read estimate as it does at the top. Does the E&OE cover this?

Yes it does

Does that clarify? Alex

Thank you so much - yes it clarifies things.Thank you for your help.

If I could invite you to rate my answer before you go today please, otherwise the site does not credit me for the time spent with you today. Thanks and good luck. Alex
