I run a one man printing business (a Limited Company).

I run a one man printing business (a Limited Company). Without permission I have accidentally put online a booklet which contained a list of names, addresses and telephone numbers. This was online for about a year and a half. When I was informed of this problem I removed it straight away and the organisation in question seems okay with this. But I am worried that some of the people named might seek redress.

Hello my name is ***** ***** I will help you with this.

This list of names etc, did you have permission? Were they of individuals please?

Customer: replied 1 year ago.
The individuals did not know about this online booklet until one of them found it while browsing the net. They did not give permission. I had originally put the booklet online as part of my attempt to see how well the service worked but I had forgotten to remove the publication. The booklet was a list of members of a fishing club and I gather many of them are quite high powered. The fishing club themselves seem happy that the booklet has been removed but I am concerned that some of the members might take legal action.

Technically this could be a breach of the Data Protection Act as unless you had permission you can't disclose personal details.

Under S.13 of the Data Protection Act 1998 they would be entitled to compensation, because you didnt have permission

Can I clarify anything for you about this today please?

Customer: replied 1 year ago.
Are there any time limits on this? Would the compensation be on a per individual basis or wouldld it be for the whole group of members? Do you know of any kinds of precedents for this kind of thing?

6 years. The compensation would be as individuals.

Does that clarify?

Customer: replied 1 year ago.
Thank you. Is it possible to give an idea of the kind of compensation involved. Would I bear the prosecution costs.

Yes there would be costs, but it would be the County Court.

It wouldnt be much, only £500 or so

Does that clarify?

Thanks again.

Ash - I paid £3 initially. Its not clear if there is an extra charge to make it up to £44. Do you know?

I dont know. The question value shows it has always been £44 from what I can see. But I can only see the question with the value on it.
