I had my window cleaned, £10 one window by one company, and paid the money into his bank after he sent an invoice. Then it went quiet for a few months. Then an email arrived with new bank details, and someone saying they had taken over the company. I phoned him and we discussed, both on the phone, and in person, that he would send official emailed invoices, along with a remittance advice through my letter box on the day the window had been cleaned and then I would send off £10. I insisted on the double receipt, and on the day of the work, as I wasn't 100% convinced they had actually cleaned the window [I work from home] He said he just needed to sort out his headed invoice design, and I would be hearing from them. That was over a year ago. I heard, and more importantly, received nothing from them. I thought they had just walked away as it was only £10 a month for them. Last week I received an invoice from a company I did not recognise for 8 months of payments going back to February of this year. After an initial email suggesting they had the wrong address, he wrote back: " We have done them since last August but did not want to send invoices back that far as we had not sent invoice until now" After reminding him that we left it that he would invoice and receipt on the day, and that I had not heard from him, I asked why he left it so late before getting in touch: "I had been sending the invoice to the wrong email addrss and just had not chased via phone as I have no number for you.....completely my fault personally I had not done this sooner - this is why I took of the other cleans - out of sheer embarrassment and understanding that I/we had let it get to this point. Have been assured by Jamie we have been going by once a month. If you need to call do, on....understand it's easier to talk via phone. I am sorry.." I, against all advice, and doubting whether they have actually been around [as I said, I work from home] am prepared to give them the benefit of some considerable doubt, and thought I would pay them [in monthly instalments] £60 as a 'gift'. Insisting that he agree that I owe them nothing, and that the extra £10 paid is a gift, and, more importantly, that i would only pay, if an emailed invoice, along with a remittance advice through the door, both arrived on the day the job was done, otherwise they would receive nothing. What is my legal position, and do you think my suggestion is ridiculous? Thanking you in advance, and huge apologies for the length of this missive, I look forward to hearing from you.
