Am I required to accept the first settlement my car insurer

This answer was rated:

Am I required to accept the first settlement my car insurer offers for a write of . They are telling me I have no choice and have sent a cheque

Hello my name is ***** ***** I will help you with this.

Do they include the words in the letter 'in full and final settlement' please?

Customer: replied 1 year ago.
We've only received an email so far, the words full and final settlement don't appear, but the broker on the phone told us it was not negotiable when we said we weren't accepting it. They said they were sending the cheque out tonight. The email they sent said if they didn't hear from us within 14 days they would assume that we accepted the valuation. We don't know what to think

Ok - then no. You dont have accept the valuation.

In any event silence is not acceptance. Unless they say it is in full and final settlement then you can accept this as PART payment anyway.

But no, you do NOT have to accept the valuation
Can I clarify anything for you about this today please?
